JAMES C. SAWRAN is actively engaged in professional liability and healthcare litigation, having represented hospitals, nursing homes, physicians and surgeons, and other healthcare providers in medical malpractice and related claims. He is lead trial counsel to one of the largest hospital corporations doing business throughout Florida. Additionally, Mr. Sawran has been involved in medical staff and peer review litigation, having successfully argued before the Florida Supreme Court a case of first impression which resulted in the Court upholding the peer review privilege relating to a physician's application and delineation of staff privileges in Cruger v. Love.
Mr. Sawran has also represented other professionals, including lawyers, nurses, and physician assistants, and has been involved in product liability actions. He is a member of the Florida Defense Lawyers Association, the American Society of Law and Medicine, the Defense Research Institute and the Florida Medical Malpractice Claims Council, Inc.
Mr. Sawran is an accomplished trial lawyer, admitted to practice in State and Federal Courts in the State of Florida as well as before the Supreme Court of the United States. Mr. Sawran has authored a number of publications related to healthcare law, and has lectured to physicians, surgeons, nurses, hospital risk managers, and medical records custodians, as well as other professionals involved in the delivery of healthcare. He is an elected member of the International Association of Defense Counsel (IADC), and serves on the Professional Liability and Medical Malpractice Committees of that organization. Mr. Sawran also has earned an "AV" rating from Martindale-Hubbell, the highest rating awarded by that organization.
Mr. Sawran has authored and co-authored a number of legal publications, including an article dealing with the recent Constitutional Amendments passed in Florida, entitled "Amendment 7: Will the Patient’s Right to Know Come At Too High A Price?" which appeared in the Spring 2005 issue of the Trial Advocate Quarterly. He has also co-authored a chapter in an upcoming book for the Florida Defense Lawyers Association (FDLA) entitled "Preparing Your Client for Deposition: Trials and Tribulations"
