CARMEN Y. CARTAYA is experienced in nursing home litigation, general insurance defense, professional errors and omissions, medical malpractice, legal malpractice and commercial litigation. She has had the opportunity to represent administrators and insurers in complex life and health insurance disputes. Her fluency in Spanish facilitates representation in matters concerning foreign contracts and policies of insurance. Ms. Cartaya has been lead counsel in the defense of a national class action asserting non-compliance with the Americans with Disabilities Act against a national hospital company.
She has authored various articles published in prestigious defense treatises and has co-authored a chapter in Trial Techniques on the defense of psychiatric malpractice claims. Ms. Cartaya is a frequent lecturer in the areas of medical negligence and long term care litigation. Ms. Cartaya has also conducted mock trial presentations in the acute care and long term care setting, focusing on medical documentation and its impact on litigation. She is a member of the Florida Defense Lawyers Association, the Defense Research Institute, the Cuban-American Bar Association and is active in South Florida community affairs. Ms. Cartaya is a member of the Peter T. Fay American Inn of Court and since 1994 has served on the Board of Directors of the National Parkinson Foundation. She is admitted to practice in the State and Federal Courts in Florida, the 11th Circuit Court of Appeals and before the Supreme Court of the United States.
