MSPC Secures Defense Verdict In Medical Malpractice Case Alleging $1.6 Million In Damages

 

Jason McGrath, Esq. and Manny Comras, Esq. both resident in the West Palm Beach office obtained a defense verdict in a case against the Lytal, Reiter, et al. firm after two weeks of trial. Plaintiff alleged that he had sustained a 3rd degree burn from a bovie pad placed on his leg during gall bladder surgery. Plaintiff was seeking to recover damages for the burn and permanent nerve damage, which according to the plaintiff's experts, caused the development of Complex Regional Pain Syndrome (CRPS).

The Defendant, Hospital, established that the Plaintiff was not burned during the surgical procedure but rather sustained an unrelated infectious wound on his leg several days after surgery. The Plaintiff had an extremely lengthy prior medical history which included unexplained lesions on his body, as well as a number of other debilitating diseases, which could have led to his development of CRPS.

Just prior to trial, Plaintiff's demand was $1.6 million dollars and at trial the Plaintiff asked the jury for an award of over $4 million dollars. In 26 minutes of deliberations, the jury rejected Plaintiff's theory of the case and found in favor of the Defendant, Hospital.
